Yes. The airline will transport death or bodily injury under the relevant convention if they travel on all international flights with 5J with an ultimate destination or stop in a country other than the country of departure. On domestic flights under the Warsaw Convention, CEB’s liability for transporting the death or bodily injury is limited in most case to approximately USD 10,000-20,000. Additional protection can easily be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the Airline’s liability under the Warsaw Convention or other relevant convention.

For every 24 hours of delay in such delivery counted from 01 hour from the arrival of the flight of the passenger carrying such baggage, Cebu Pacific will tender an amount of 2,000 PHP to the passenger as compensation for the inconvenience the latter experienced.

According to the Warsaw Convention, on international flights, 5J’s liability limit for lost or damaged baggage is approximately USD9.07 per pound or USD20.00 per kilo for checked baggage. In some special cases that the law of country or destination (not the Philippines) requires, the liability of 5J for delay, lost, or damage can be governed by the higher liability rules of any other applicable international convention. On domestic flights, 5J’s liability for lost or damaged baggage is equivalent to half of the amount prescribed under the Warsaw Convention or the relevant convention in its Peso equivalent.

In case, passengers declare in writing based on an excess valuation facility a higher value for their baggage before the flight, and pay for extra charge imposed by the airline, the liability of the airline will be limited to that higher value.

In this case, CEBU Pacific Air will not take any liability for the lost or damage of baggage if it is not the airline’s fault.

No. Cebu Pacific will not take responsibility for any damage cause from its compliance with applicable laws or government rules and regulations or from the passenger’s failure to comply therewith.

No. Ceb is not liable for damage caused by the passenger or his baggage. The passenger is responsible for the damage he has caused, or to other persons or property.

Cebu Pacific Air has no liability whatsoever for damage to items not allowed in checked and hand baggage, or for items unsuitably packed, perishable, damaged or fragile items or cosmetic or superficial damage caused to baggage as a result of normal wear and tear during carriage.

5J is not responsible for any illness, or disability, including death, attributable to the passenger’s physical condition at the time he takes his flight or for the aggravation of such condition by reason of his taking the flight.

The airline reserves the right to dispose baggage which remains unclaimed for a period of thirty (30) days after the arrival of the flight.
